These Terms of Service ("Terms") form a legal agreement between you and Frozen Catch Sweets developed by JM Mobile Tech ("we," "us," or "our") regarding your use of the Frozen Catch Sweets mobile application (the "App"). By installing, accessing, or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement.
2. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, for your personal, non-commercial use.
3. Restrictions
You agree not to, and not to allow any third party to:
- Copy, modify, distribute, sell, lease, or sublicense any part of the App;
- Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law;
- Use the App in any unlawful manner, or in a way that infringes the rights of others;
- Use the App to transmit viruses, malware, or other harmful code;
- Interfere with or disrupt the integrity, security, or performance of the App.
4. User-Provided Content
The App allows you to attach your own photos to recipes. This content is stored only on your device and is not transmitted to us. You are solely responsible for any content you create, and you must ensure that you have the right to use it.
5. No Wagering, No Real-Money Play, No Payouts
The App is a brand promotion utility — a frozen treats cookbook with playful catch mechanics. The Wheel, Combiner, and catch unlock features are recipe reveal mechanics, not gambling features. The App does not offer real money play, wagering, in-app purchases, prizes redeemable for cash, or any form of payout.
6. Intellectual Property
The App, including its source code, design, graphics, recipes, illustrations, trademarks, and other content, is owned by Frozen Catch Sweets developed by JM Mobile Tech or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use any of our trademarks or logos without our prior written consent.
7. Updates
We may release updates, patches, or new versions of the App from time to time. Some updates may be required to continue using the App. We may also discontinue the App or any feature at any time without notice.
8. Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Recipes and tips are provided for informational purposes only. You are responsible for verifying ingredients, allergens, freezer safety, food handling guidelines, and the suitability of any recipe for your circumstances.
9. Limitation of Liability
To the maximum extent permitted by law, in no event shall Frozen Catch Sweets developed by JM Mobile Tech, our affiliates, or our suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the App.
Our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid us for the App in the twelve months preceding the claim, or (b) USD 50.
10. Indemnification
You agree to indemnify, defend, and hold harmless Frozen Catch Sweets developed by JM Mobile Tech and our officers, directors, employees, and agents from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App, your breach of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the license granted in Section 2 will immediately end, and you must stop using and uninstall the App.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Frozen Catch Sweets developed by JM Mobile Tech is established, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the competent courts of that jurisdiction, unless otherwise required by mandatory consumer protection laws of your country of residence.
13. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Effective" date at the top of this page. Continued use of the App after the changes take effect constitutes acceptance of the revised Terms.
